3 Timeline Milestones Every EB-5 Investor Should Know Before Filing

Reviewed by John Hu, founder of John Hu Migration Consulting and Registered Migration Agent (MARN 0746141).

Between 2026 and 2027, EB-5 investment immigration has 3 critical timeline milestones that every prospective applicant should understand clearly. Planning ahead maximizes the protections available to an application — missing any one of these dates could mean losing legal protections an applicant would otherwise be entitled to.

Why Does the Timing of Filing I-526E Matter So Much?

Many investors assume that once US investment immigration program rules are set, the investment amount, review criteria, and benefits stay fixed regardless of when an application is filed. The reality is the opposite.

Since the EB-5 Reform and Integrity Act (RIA 2022) took effect, the EB-5 program has operated under staged authorizations — and each authorization period can come with its own investment amount, review criteria, and quota rules. This means the timing of an I-526E filing directly determines which rule set applies — not when the applicant eventually receives their green card.

Understanding the following 3 milestones is essential to making the right decision.

Milestone 1 — 30 September 2026: Grandfathering and the Filing Protection Shield

What Is Grandfathering?

Grandfathering is the most important legal protection mechanism under RIA 2022\. It ensures that investors who file an eligible I-526E application on or before 30 September 2026 will be assessed entirely under the legal standards in effect at the time of filing — regardless of how the program subsequently changes.

Specifically, Grandfathering protects:

  • The USD 800,000 investment amount, locked in even if the law is later adjusted
  • Review standards applied as they stood at the time of filing, not retroactively updated to new policy
  • Visa category and quota allocation under the current structure
  • All benefits extending to the investor, spouse, and unmarried children under 21

Why Does 30 September 2026 Matter?

30 September 2026 marks five years since Congress passed RIA 2022 — and it’s also the point at which the Regional Center program’s current authorization requires Congress to renew or replace it. Possible scenarios include:

  • Congress extends authorization but with new conditions and a higher investment amount
  • The program is temporarily suspended during renegotiation
  • The USD 1 million Gold Card program formally replaces EB-5

Investors who file before 30 September 2026 stand entirely outside these risks — already protected under Grandfathering.

What Documentation Is Needed Before Filing?

To file I-526E in time before 30 September, investors should begin preparing at least 2-3 months in advance:

  • Select and vet a suitable EB-5 project
  • Prepare source-of-funds documentation (traceability, legitimacy, full supporting evidence)
  • Sign an investment agreement with the Regional Center
  • Complete personal and background documentation
  • Submit I-526E to USCIS

Milestone 2 — 1 January 2027: Inflation-Driven Pressure on Investment Amounts

RIA 2022’s Automatic Investment Amount Adjustment

One easily overlooked but critical detail: RIA 2022 requires the minimum EB-5 investment amount to be automatically adjusted for inflation every 5 years, with the first adjustment taking effect 1 January 2027.

Based on current economic projections, the adjusted minimum investment could rise to:

Current amountProjected adjusted amount
USD 800,000USD 930,000-950,000
USD 1.05 millionUSD 1.2-1.25 million

For TEA areas, that’s an estimated increase of USD 130,000-150,000 — a meaningful amount for any investor.

The Practical Impact

Investors who filed before 30 September 2026 aren’t affected by this adjustment — they’re already protected under Grandfathering. But those who wait until after 30 September must:

  • File at the new, higher investment amount
  • Forgo Grandfathering protection under the old law
  • Simultaneously face the risk of further program condition changes

Milestone 3 — 30 September 2027: The Program Renewal Deadline and Market Expectations

Why Does 30 September 2027 Matter?

If the Regional Center program is renewed or replaced by the end of 2026, the next authorization period is expected to run through 30 September 2027 — widely considered the window where the most significant EB-5 changes since RIA 2022 could take place.

Scenarios that could unfold in or before this period include:

  • Gold Card formally launches: if the USD 1 million Gold Card program is formally passed by Congress and implemented, the traditional EB-5 pathway could be significantly narrowed or eliminated
  • Growing retrogression: with more than 15,000 investors in the Reserved category already awaiting visa processing, pressure on visa quotas continues to build — especially for the Rural category (roughly 4,100 visas/year), where retrogression is likely to worsen
  • Tighter adjudication standards: USCIS may continue tightening its review process for I-526E and I-829

What This Means for Current Investors

Filing before 30 September 2026: your I-526E is already submitted and in review, giving you priority ahead of later filers, sidestepping all the uncertainty of the post-2027 phase, and improving your chances of securing a green card before the market grows more volatile.

Waiting until this later period: you’ll face a higher investment amount, potentially stricter conditions, and a more competitive market.

Recommended Action Timeline

Based on these 3 milestones, John Hu Migration Consulting recommends the following timeline for applicants considering EB-5 investment immigration:

  • Now through September 2026 — Consultation and project selection: this is the last window to move through the process at a comfortable pace. Get in-depth advice on project selection, vet the financial structure, and assess your personal source-of-funds file
  • August-September 2026 — Prepare and file I-526E: complete all source-of-funds documentation, sign the investment agreement, and submit I-526E to USCIS before 30 September 2026
  • After 30 September 2026 — Monitor and await adjudication: a properly filed application is protected under Grandfathering and proceeds through normal review — unaffected by any subsequent policy changes

FAQ

  • If I can't file before 30 September 2026, does that mean I can't apply for EB-5 at all?

No. Even after missing this deadline, you can still file under whatever rules apply at that time — you simply won't have Grandfathering protection, and will face a higher investment amount and potentially stricter conditions. It's worth consulting a licensed adviser as soon as possible to assess whether you can still meet the original timeline.

  • Is the January 2027 inflation adjustment the same as the rumored increase to USD 1.4 million for hot employment areas?

Not exactly. The former is RIA 2022's built-in 5-year automatic inflation adjustment mechanism. The latter is a separate proposed DHS rule specifically targeting high-employment "hot" areas. They're different mechanisms, but point in the same direction — underscoring the value of filing early.

To fully understand the EB-5 investment immigration requirements, review US EB-5 investment immigration details; for the latest proposal on raising thresholds in hot employment areas, see EB-5’s proposed threshold hike to USD 1.4 million.
