The proposed changes are scheduled to take effect on March 29, 2019.<br \/><br \/><strong>The government proposals are scheduled to take effect on March 29, 2019<\/strong><strong>, but still require parliamentary approval.\u00a0<\/strong><br \/><strong>New Innovator Visa Category to Replace Tier 1 (Entrepreneur)<\/strong><br \/>Tier 1 (Entrepreneur) route to be closed. The Innovator visa would replace the Tier 1 (Entrepreneur) route which would be closed to new applicants from March 29, 2019.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>English language levels will be set at B2 (higher than B1 for the current Entrepreneur)<\/li>\n<li>New expert endorsement requirement. Applicants would need to be endorsed by a designated endorsing body approved by the UK government, who would assess whether the applicant\u2019s proposed business is innovative, viable and scalable. The Home Office has not confirmed which bodies would be authorised to issue endorsements\u00a0yet, but has set out criteria with which the endorsing bodies must comply.<\/li>\n<li>Eligibility for Indefinite Leave to Remain (settlement). Innovators who satisfy at least two of the Home Office\u2019s new criteria may qualify for settlement after 3 years, down from five under the existing route. The criteria include:\u00a0<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Investing at least GBP 50,000 into a business;<\/li>\n<li>Doubling the business\u2019s customers;<\/li>\n<li>Applying for intellectual property protection after research and development activity;<\/li>\n<li>Generating annual\u00a0gross revenue of GBP 1 million;<\/li>\n<li>Creating 10 full-time jobs for resident workers.<\/li>\n<\/ul>\n\n<p><!--nextpage--><\/p>\n<p>&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\">Effect on existing Tier 1 (Entrepreneurs). Existing Entrepreneurs can continue to extend their visa under the current rules until April 5, 2023, but would be required to provide more detailed information on their role in the business and the jobs they have created. Settlement applications for existing Entrepreneurs will remain open until\u00a0 April 5, 2025.<br \/><br \/><strong>New Changes to Tier 1 (Investor) Route<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Increased scrutiny over funding. New Investor visa applicants would need to prove they have had control of the required GBP 2,000,000 investment funds for the last 2 years, up from 90 days under the existing rules. If the funds have been held for a shorter period, applicants would need to demonstrate the source of the investment funds. The banks must carry out all due diligence checks before opening accounts for potential applicants.\u00a0\u00a0<\/li>\n<li>Investment in government bonds no longer accepted. Under the proposed changes, investment in government bonds would be precluded,\u00a0to incentivise investment in active and trading UK companies.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed changes will apply to all new applications made on or after March 29, 2019.
